Fast Forward Superchargers Terms of Service

1. Agreement to these terms

These Terms of Service govern your use of the Fast Forward Superchargers website and purchases from Knack Toys LLC, doing business as Fast Forward Superchargers (FFS). By using the website or placing an order, you agree to these Terms and the policies linked from the website, including the Returns & Refunds, Shipping, Privacy, and applicable warranty policies.

If you do not agree to these Terms, do not use the website or place an order.

2. Website and account use

You may use this website only for lawful purposes. You are responsible for providing accurate, current, and complete account, billing, shipping, vehicle, and order information. You are responsible for safeguarding your account credentials and for activity performed through your account.

You may not interfere with the website's operation or security, attempt unauthorized access, use automated means to circumvent purchase restrictions, introduce malicious code, scrape the website in a way that burdens or disrupts it, or use the website to violate another person's rights or applicable law.

3. Product information, vehicle fitment, and installation

FFS works to present accurate product descriptions, photographs, specifications, prices, availability, fitment, and instructions. Vehicle condition, prior modifications, regional requirements, and configuration differences can affect compatibility. Review the complete product page and select the correct model year, steering, transmission, and other configuration before ordering. Contact FFS before ordering if fitment is uncertain.

Professional installation is recommended for FFS supercharger kits and performance parts but is not required to maintain warranty coverage. Products must be installed and used correctly in accordance with the applicable FFS instructions. Installation, tuning, inspection, maintenance, and safe vehicle operation remain the customer's responsibility except to the extent a problem is caused by an FFS-supplied defect or applicable law provides otherwise.

4. Emissions and lawful use

Product-specific emissions and road-use information is part of the product description and must be reviewed before purchase and use. Where an FFS configuration is covered by a California Air Resources Board Executive Order, FFS identifies the applicable coverage and conditions. Do not interpret CARB exemption language as an endorsement by CARB.

FFS does not offer ordinary California public-road ordering for 2004–2005 Miata supercharger-kit configurations that are not covered by the applicable Executive Order. A potential California competition-vehicle order requires documentation and FFS approval before purchase. FFS may refuse, hold, or cancel an order when reasonably necessary to comply with emissions, shipping, safety, fraud-prevention, or other legal requirements.

Customers outside California are responsible for determining and following the laws and rules that apply where a vehicle is registered, operated, or used. Nothing in these Terms authorizes unlawful installation or use.

5. Prices, orders, and payment

Prices are shown in the currency displayed by the store and may change before an order is placed. Applicable shipping charges and taxes are shown during the order process. Placing an order is an offer to purchase. FFS may accept, decline, hold, or cancel an order for reasons including product or component availability, incorrect pricing or product information, suspected fraud, inability to verify information, or legal/compliance restrictions.

If FFS cancels an order after payment, FFS will issue the refund required by the applicable policy and law. FFS may correct an obvious pricing or product-information error before shipment and will contact the customer when a decision or additional payment is required.

6. Built-to-order production and shipping

FFS supercharger kits are built to order. The production estimate shown when an order is placed applies to that order. Production time is separate from carrier transit time. Current production, shipping-charge, transit, delivery, damage-reporting, and delay terms are stated in the Shipping Policy.

Estimates are not guaranteed delivery dates. If FFS cannot ship within the timeframe promised when the order was placed, FFS will provide the options required by applicable law, which may include accepting a revised shipment date or canceling for a full refund.

7. Cancellations, returns, refunds, and warranty

Customer-requested cancellations, returns, and refunds are governed by the Returns & Refunds policy in effect when the order is placed. FFS-caused delays, FFS cancellations, incorrect shipments, and confirmed covered defects receive the treatment stated in that policy and applicable law.

FFS products covered by the FFS One-Year Limited Warranty receive the coverage, exclusions, claim process, shipping treatment, and remedies stated in that warranty. Nothing in these Terms disclaims or modifies implied warranties in a manner prohibited by law, reduces the written FFS One-Year Limited Warranty, or limits rights that cannot legally be waived.

8. Website content and intellectual property

The website and its original text, graphics, photographs, videos, designs, logos, product names, software, and other content are owned by or licensed to FFS and are protected by applicable intellectual-property laws. You may view and use the website for personal shopping, product support, and other ordinary noncommercial purposes. You may not reproduce, republish, sell, modify, or exploit FFS content without permission, except as applicable law allows.

Product names, company names, vehicle names, and trademarks belonging to others remain the property of their respective owners. Reference to Mazda, Miata, MX-5, CARB, component manufacturers, or other third parties does not imply endorsement unless FFS expressly states otherwise.

9. Third-party services and links

The website may use or link to services operated by Shopify, payment providers, shipping carriers, video platforms, social networks, or other third parties. Their own terms and privacy practices govern their services. FFS is not responsible for third-party websites or services it does not control, but this provision does not reduce responsibility that applicable law places on FFS for an FFS sale.

10. Errors, interruptions, and changes

FFS may correct errors or omissions, update information, change or discontinue website features, and restrict access when reasonably necessary. FFS does not promise that the website will always be available or error-free. If an error materially affects an order already placed, FFS will contact the customer and provide the treatment required by the applicable policy and law.

11. Limitation of liability

To the maximum extent permitted by applicable law, FFS is not liable for indirect, incidental, special, exemplary, or consequential losses arising from website use or an FFS product, including loss of use, vehicle downtime, towing, lost profits, or lost data, except where the FFS One-Year Limited Warranty or applicable law expressly provides otherwise.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. Some jurisdictions do not permit certain exclusions or limitations, so some of this section may not apply to you.

12. Suspension and termination

FFS may suspend or terminate website or account access for unlawful activity, attempted fraud, abuse, security threats, interference with the website, or a material violation of these Terms. Provisions that by their nature should continue after termination—including payment obligations, intellectual-property provisions, warranty and policy rights, liability limitations, and dispute provisions—remain in effect.

13. Severability and waiver

If a provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision once is not a waiver of the right to enforce it later.

14. Governing law and venue

These Terms and transactions with FFS are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Subject to rights and venue rules that applicable consumer law does not permit the parties to change, legal proceedings relating to these Terms or an FFS transaction will be brought in the state courts located in Harris County, Texas, or the federal courts whose jurisdiction includes Harris County, Texas.

15. Changes to these terms

FFS may update these Terms prospectively. The version posted when an order is placed governs that order unless a later change is required by law or the customer expressly agrees to it. The current version will show its latest update date.
